Extended Structural Guarantee
Homes built by Rawson Homes now come with a Lifetime Structural Guarantee. This guarantee provides warranty against a Lifetime Guarantee Defect as defined below, where Rawson Homes, as the builder in the contract, will rectify any Lifetime Guarantee Defects that arise from the date of practical completion until the owner's death (where the owner under the contract is a natural person), until the land is transferred to another person or entity; or in the case of a corporate entity or trust, until the date which is 50 years from the date of practical completion or until the land is transferred from the owner to another person or entity.
What is a Lifetime Guarantee Defect?
The Lifetime Guarantee Defect means the structural failure of:
- foundation systems, concrete and or strip footings (where ‘structural failure’ is defined pursuant to the Building Code of Australia and is considered ‘Damage Category 3’ or higher in relation to AS 2870 under relevant Australia Standards); or
- structural timbers and steel in wall or roof framing (where ‘structural failure’ is defined pursuant to the Building Code of Australia and all relevant Australian Standards, including AS 1684); or
- load bearing brickwork (where structural failure is defined pursuant to the Building Code of Australia and all relevant Australian Standards including AS 4773),
in respect of the building works undertaken by Rawson Homes under your build contract.
What is excluded from the Lifetime Structural Guarantee?
The Lifetime Structural Guarantee does not apply where, in the reasonable opinion of the builder, the Lifetime Guarantee Defect is caused or contributed to by:
- acts of God, natural disasters (including but not limited to earthquakes, cyclones, fires, explosions, heavy rain, floods, landslides, lightning, storms, tempest, infestation of pests, drought or meteors), war, sabotage, malicious damage or terrorism;
- the owner’s misuse and or neglect of the dwelling or the land;
- land conditions, latent or otherwise, which are outside of the builder’s control;
- trees or shrubs growing near the footing of the dwelling;
- inadequate surface drainage where the owner has undertaken landscaping works on the land;
- the owner’s failure to maintain a pest or termite prevention treatment program for the dwelling;
- the owner’s failure to maintain or repair or the improper use of the fittings or fixtures on the land including, drains, pipes, pits, plumbing works and electrical wiring;
- the owner’s failure to maintain the dwelling and any other part of the land in accordance with CSIRO’s Guide to Foundation Maintenance and Footing Performance (including any revisions of the guide) and any other landscaping and drainage maintenance guidelines provided by the builder to the owner; or
- any renovations, extensions, alterations, substantial landscaping, excavation works, the addition of a pool or any other works undertaken on the land, at any time, by a party other than Rawson Homes.
‘Dwelling’ means the structure/s built on the land pursuant to the building works under your contract.
‘Land’ means the land described in your contract.
Is the Lifetime Structural Guarantee transferrable?
The Lifetime Structural Guarantee is exclusively granted to the owner under the contract and may not be assigned or transferred to another person or entity. In addition, the Lifetime Structural Guarantee does not transfer with the land, meaning that if the owner sells the land, the Lifetime Structural Guarantee will be voided from the date that the sale of the land is completed.
